Roma Civil Monitor is a pilot project with the full title of 'Capacity building for Roma civil society and strengthening its involvement in the monitoring of national Roma integration strategies' and is carried out for EU Justice and Consumers. The objective of the pilot project is to contribute to strengthening the monitoring mechanisms of the implementation of the national Roma integration strategies through systematic civil society monitoring.

Le Conseil d'Etat rejette un recours de la RTBF, punie pour des propos sur les "gitans"
Début novembre, le Conseil d'Etat a rejeté une requête de la RTBF contre une décision du Conseil supérieur de l'audiovisuel (CSA) qui la sanctionnait pour avoir diffusé sur la radio Vivacité Charleroi des propos incitant à discriminer les gens du voyage. Le CSA ainsi que le centre interfédéral pour l'égalité des chances Unia se réjouissent que cet arrêt "vienne clarifier l'application du droit audiovisuel sur la question fondamentale de l'incitation à la haine ou la discrimination", ont réagi mardi les deux institutions.
Le 22 novembre 2016, durant l'émission "Charleroi Matin", Alain Simons avait à deux reprises prévenu ses auditeurs de "la présence de gitans". "Voilà, alors faites attention, on sait jamais, fermez bien les portes. Si vous avez des trucs volables chez vous, prenez vos précautions", avait-il ajouté.
Si la RTBF avait d'emblée reconnu une faute dans le chef d'Alain Simons, lequel s'était publiquement excusé et avait été suspendu de ses fonctions pendant une semaine, elle réfutait toute infraction : M. Simons n'a pas immédiatement compris la portée de ses propos et n'a dès lors pas eu l'intention de pousser à la discrimination, avait-elle plaidé devant le CSA.
Le régulateur n'avait pas suivi cet argumentaire et avait imposé au média de service public de diffuser un communiqué pour faire savoir à ses auditeurs qu'il avait été condamné en raison des propos d'Alain Simons.
Saisi, le Conseil d'Etat a confirmé que la législation audiovisuelle permet de sanctionner un média en raison d'un contenu illicite, indépendamment de la responsabilité civile ou pénale et des intentions des personnes physiques à l'origine de ce contenu. "En invitant les auditeurs à la vigilance, à s'enfermer et à dissimuler les objets susceptibles d'être volés en raison d'une rumeur relative à la présence de 'Gitans qui rôdent', le programme édité par la partie requérante a bien réalisé une action destinée à orienter un comportement déterminé et a encouragé un sentiment d'animosité ou de rejet contre un ensemble de personnes présentées comme des délinquants en puissance", a relevé la juridiction.
Le CSA peut imposer des sanctions avec un objectif "pédagogique vis-à-vis du public, et non purement punitif", a aussi souligné le Conseil d'Etat.
